On December 7, 2017, RBE Attorney Courtney Mills presented oral argument before the Indiana Supreme Court in the matter of Paul Gresk v. Cortney Demetris, M.D. The case involved a minor and her family who filed a proposed medical malpractice complaint against a doctor who reported suspected medical child abuse to the Department of Child Services, but the Marion Superior Court dismissed the complaint, relying on the Anti-Strategic Lawsuits Against Public Participation (“SLAPP”) statute. The Court of Appeals reversed and remanded after concluding the statute does not apply here. Gresk v. Demetris, 81 N.E.3d 645 (Ind. Ct. App. 2017). The Supreme Court has granted transfer, vacated the Court of Appeals opinion and assumed jurisdiction over the appeal.
