SCOTUS Accepts Indiana Nursing Home Case

RBE successfully obtained a dismissal of claims under the Federal Nursing Home Reform Act against RBE clients, Health and Hospital Corporation of Marion County and American Senior Communities, from the U.S. District Court for the Northern District of Indiana in 2020 by arguing that the FNHRA does not create private rights of action for individuals. Following a decision by the Seventh Circuit Court of Appeals reversing the dismissal, the U.S. Supreme Court recently agreed to take up this case to determine whether the FNHRA creates private rights of action for individuals to bring against government-funded nursing homes. RBE is excited to be a part of this ongoing process to create law at the highest levels on behalf of our clients.
